The Basic Court in Pljevlja Issues Two Indictments and Ten Charges for Illegal Weapons Possession and Carrying

In 2024, the Basic Court in Pljevlja saw two indictments and ten proposal for indictments filed for the criminal offense of illegal possession and carrying of weapons and explosives, as outlined in Article 403 of the Criminal Code of Montenegro.

Marina Jelovac, the president and spokesperson of the Basic Court in Pljevlja, provided this information.

This significant increase in filed indictments and proposals marks a considerable rise compared to previous years.

In 2020, only one indictment was filed against two individuals for the same offense, and in 2021, there were two indictments.

For the year 2022, one indictment was filed, followed by three indictments and six proposals in 2023 for illegal possession and carrying of weapons and explosives.

According to Jelovac, “In 19 concluded cases, five defendants received prison sentences to be served in their residence and were subjected to the security measure of confiscation of items. Additionally, ten defendants received suspended sentences along with the confiscation measure, while one other defendant was given a suspended sentence. Two defendants were sentenced to distinct prison terms of four months each; one for illegal hunting under Article 325, paragraph 4, in connection with illegal possession and carrying of weapons and explosives, and the other for theft under Article 239, paragraph 1, alongside the same weapons offense. One defendant was acquitted, and the charges against another were dismissed.”

As for three cases still pending final judgment, one defendant received a sentence to be served at their residence, alongside a confiscation measure, while two defendants were granted suspended sentences and similar confiscation orders. Proceedings in these three cases remain ongoing.
