Silence Surrounds the European Commission’s Evaluation of the Majority’s Unconstitutional Decision on Judge Đuranović

There is currently no commentary from the European Commission regarding the unconstitutionality of the majority decision concerning Judge Dragana Đuranović, stated Boris Mugoša, head of the Social Democrats (SD) parliamentary group and representative of the European Union.
The EU noted that Mugoša provided comments on the evaluations found in the European Commission’s Non-Paper regarding Montenegro’s advancement in negotiation chapters 23 and 24.
“There has been no response to the European Commission’s evaluation of the unconstitutionality regarding Judge Đuranović. This silence persists despite our clear and sincere warnings that these actions are not born out of any personal feelings towards the judge, but rather from the principle that democracy is not merely the will of the majority, as it has often been misrepresented, but fundamentally the rule of law. This silence should be addressed by all those who have loudly proclaimed their adherence to the Constitution, including ruling political parties, the Prime Minister, relevant vice presidents and ministers, and numerous experts who see themselves as knowledgeable in this domain,” Mugoša stated.
He also highlighted the irony of how representatives from certain parties are now eagerly anticipating the Venice Commission’s opinion, despite having previously dismissed such evaluations.
“Rather than indulging in self-congratulatory rhetoric about Montenegro’s rapid progress toward EU membership, government officials would do well to closely re-read the European Commission’s Non-Paper on Montenegro’s progress in negotiation chapters 23 and 24. It clearly outlines the extent to which they are deliberately hindering Montenegro’s path to the EU,” Mugoša emphasized.
