Lazarević Ordered to Compensate Gogić with €2,000 Plus €766 in Court Fees.

The High Court in Bijelo Polje has confirmed the ruling of the Basic Court, which mandates Lazar Lazarević from Bijelo Polje to pay 2,000 euros in compensation for non-pecuniary damages. This is due to the infringement of his personal rights, honor, and reputation towards the former commander of the Police Station of the Security Center (CB) Bijelo Polje, Danko Gogić, along with an additional 766.33 euros in court costs.
This decision partially endorsed the claim filed by prosecutor Gogić, who sought compensation of 3,000 euros for the emotional distress he experienced.
Gogić initiated civil proceedings in the Basic Court for the breach of personal rights and non-pecuniary damages because Lazarević allegedly posted a video on his Facebook profile in 2020. In this video, he claimed that Gogić removed a Serbian tricolor flag from a repeater on Bjelasica and disposed of it.
Following the video’s release, it garnered attention on social media and local news outlets, sparking numerous negative comments directed at Gogić, who refuted the claims.
The three witnesses suggested by Lazarević did not corroborate his statements, as they were not present at the incident.
Gogić asserted that he did not remove or desecrate any flag and that the publication of the video caused him mental distress due to the derogatory comments he received on social media, as well as in private messages through Messenger.
