Bećirović Calls for Constitutional Court of BiH to Examine Legality of Laws Passed by RS Parliament

Denis Bećirović, the Bosniak member of the Presidency of Bosnia and Herzegovina (BiH), plans to file a request with the Constitutional Court of Bosnia and Herzegovina to assess the constitutionality of legislation passed by the National Assembly of Republika Srpska (RS). These laws, as stated, seek to deny the supremacy of the state’s authority over the entities within BiH.
Alongside Bećirović, the request will also be supported by members of the Parliamentary Assembly of BiH, Denis Zvizdić (NiP) and Kemal Ademović (SDP), as announced by the Office of the Bosniak member of the BiH Presidency.
The statement stressed that “the unlawful actions taken by RS authorities necessitate a decisive and unified response from all state officials within BiH.”
“The consistent assaults on the Dayton Peace Agreement and the constitutional framework of BiH must cease. Efforts to undermine BiH’s independence, sovereignty, and territorial integrity pose a direct threat to the peace and stability of both the nation and the region,” the statement emphasized.
Recently, the RS National Assembly has enacted a law that prohibits the operation of the Court and Prosecutor’s Office of BiH, as well as the BiH Investigation and Protection Agency (SIPA), within that entity.
Additionally, legislation has been adopted to establish the High Judicial and Prosecutorial Council of the RS, effectively ending the jurisdiction of the HJPC BiH within RS. An appeal regarding the constitutionality of these laws can only be lodged with the Constitutional Court of BiH after they take effect, which will be marked by their publication in the Official Gazette of the RS.
