Encouraging Alternative Dispute Resolution in Business

It is essential to advance alternative dispute resolution in the economy to establish it as a standard practice, stated Maja Golović Vojinović, executive director of the Center for Alternative Dispute Resolution.

She emphasized the flexibility and effectiveness of this dispute resolution method, highlighting the numerous advantages it offers.

“Modern legal systems acknowledge this method as a standard for resolving economic disputes. Although our country is experiencing a slight increase, the current level remains unsatisfactory for addressing commercial disputes. Events like this aim to promote and validate alternative dispute resolution methods that provide significant benefits to the economy,” Golović Vojinović remarked during a roundtable on the Advantages of Resolving Commercial Disputes through Mediation, held at the Science and Technology Park in Podgorica.

The roundtable was hosted by the Center for Alternative Dispute Resolution in collaboration with the Union of Employers (UPCG).

The MEF stated that as business accelerates and the market demands prompt responses, the necessity for innovative and effective dispute resolution methods among business entities becomes increasingly apparent.

Suzana Radulović, Secretary General of the MEF, pointed out that the judicial system is overwhelmed with numerous challenges, including a shortage of judges and a backlog of cases.

“It’s clear that the economic perception of slow and limited access to justice is entirely justified,” noted Radulović.

She further explained that mediation in commercial disputes and arbitration are crucial methods that ought to be integral to a contemporary, efficient legal protection system.

“We believe that mediation in commercial disputes has yet to gain sufficient traction and recognition, and there are lingering reservations regarding trust in new protective mechanisms. The takeaway from this event is that more commercial disputes should be resolved through the Center for Alternative Dispute Resolution, as they provide quicker, more professional resolutions with significantly lower costs compared to court processes,” Radulović added.

She highlighted that this approach maintains a fair relationship between the disputing parties, protecting the trust that has been cultivated over time.

Through opinion exchange and practical analysis, panelists highlighted the primary advantages of mediation in resolving commercial disputes, from easing the burden on courts and saving time and costs to enabling quicker decision-making without lengthy court battles and preserving the reputation of companies, thus maintaining stable partnerships among business entities.

The gathering saw participation from representatives of the judiciary, legal experts, the academic community, and numerous members of the business sector – members of the MEF.

This roundtable marks the first in a series of collaborative events envisioned by the recently signed Agreement on Cooperation between the Center for Alternative Dispute Resolution and the MEF, aimed at fostering a culture of dialogue and promoting mediation among business entities.
