A 46-year-old man, SM, from Bijelo Polje will remain in custody after threatening to kill his mother and brother, insisting they stay out of a home he refers to as “his grandmother’s house.”

He was taken into custody on April 1st, after his mother, enduring ongoing violence, chose to end the cycle and report him.

She informed the prosecutor that she had reported him six months prior but felt sympathy for him and subsequently withdrew her complaint.

The man from the Pripčići neighborhood faces charges of domestic violence and has been ordered detained until a further court decision.

The Bijelo Polje Higher Court reviewed the appeal from his defense attorney and concluded that there is reasonable suspicion based on the existing evidence that he committed the alleged crime.

The judges detailed that he jeopardized his mother’s safety in their family home by threatening her during a brief argument, stating, “No one is allowed to enter here, this is my grandmother’s house,” followed by, “When S. comes, I will kill you,” which instilled fear in her.

The reasonable suspicion arises from the testimony of the injured party, MM, who explained that she lives in their family home with her son S., which is an aging structure they built together, now partially in disrepair.

On April 1, as she was in her room with her son S., he questioned the whereabouts of a jacket gifted by her nephew. When she replied she didn’t have it, he asserted dominion over the house and threatened her life.

“She argued with S., questioning him about his aggressive behavior, where his grandmother’s house was located, and reflecting on her 50 years of care. He insisted it was his grandmother’s house and accused her of seeking help from L, who had previously harmed her husband, resulting in a speech disorder. She also noted that when she is ill, S. and his children do not visit her due to their lack of communication with him. S. has a drug issue, and both when he’s angry and when he’s out at night, she feels apprehensive. Despite earlier threats leading her to report him, she ultimately withdrew her complaint, feeling sympathy,” the judges quoted her statement.

The judges emphasized that the detention is warranted, especially considering SM’s past convictions for similar offenses, marking him as a repeat offender, along with the long-standing discord between him and the injured party.
