The Ministry of Tourism has responded to the article titled “Against the Fairground in Budva with Tacit Consent,” which was published on August 20, 2025, on the “Vijesti” portal.

“The claims made in the aforementioned article asserting that the Ministry of Tourism granted ‘tacit consent’ to the Proposal for the Program of Temporary Facilities for the Municipality of Budva for the period 2024–2028 are incorrect. Rather, in response to the request from the Commission working on this Program, the Ministry, with act number 05-123/25-4567/2 dated July 8, 2025 – in accordance with Article 72 of the Law on Construction of Facilities (‘Official Gazette of Montenegro’, number 19/25) – denied granting consent due to identified significant deficiencies. This decision was formally communicated to the Commission.

It is crucial to highlight that this is not merely a ‘non-binding’ opinion, but a decisive stance from a state authority, ensuring adherence to legal protocols, professional standards, and the safeguarding of citizens’ and the tourism sector’s interests.

The Law on Construction of Facilities explicitly states that the Program of Temporary Facilities must be approved by the Budva Municipal Assembly for a duration of five years, but only with prior written consent from the relevant state authorities, including the Ministry of Tourism. Consequently, we find any arbitrary interpretations of this legal requirement unacceptable and urge the Budva Municipality and the Commission to faithfully apply the law in their operations.

“Let us remind you that adopting the Program without the Ministry’s consent constitutes a severe breach of legal regulations. The Ministry of Tourism will persist in upholding the principles of legality and sustainable development for the benefit of the citizens and the tourism industry of Montenegro,” concludes the response.
