The RS National Assembly adopted information on the overthrow of the BiH Constitution

The RS National Assembly Approves Report on the Overthrow of the BiH Constitution

The National Assembly of Republika Srpska held a session tonight, adopting information regarding the violation of the Constitution of BiH, outlining measures and tasks to preserve it. They concluded that the Court of BiH’s ruling constitutes an act of coup d’état, leading to a total breakdown of the constitutional order, as it based its verdict on an unelected foreign official, Kristijan Šmit, rather than on laws passed by the Parliamentary Assembly of BiH.

The Assembly categorically rejects any decision made by Christian Schmidt, as per the conclusions reported by RTS.

Today, RS President Milorad Dodik received a final sentence of one year in prison and a six-year prohibition from holding office due to non-compliance with the High Representative’s decisions. Conversely, Miloš Lukić, the acting director of the RS Official Gazette, was acquitted in the initial proceedings.

Furthermore, the National Assembly declares all laws and decisions from bodies not authorized by the Constitution of BiH, notably the High Judicial and Prosecutorial Council, the Prosecutor’s Office of BiH, the Court of BiH, and the Investigation and Protection Agency of BiH, to be invalid, according to their conclusions.

The Assembly highlights that the Court of BiH’s decision to act based on an imposed resolution violates the Constitution of BiH and constitutes a dismantling of the constitutional order.

The Parliament urges the Attorney General’s Office of Republika Srpska to file criminal charges against the prosecutors of the Prosecutor’s Office of BiH and judges of the Court of BiH who complied with the imposed decision, for orchestrating and preparing criminal activities against the constitutional order. These charges will be submitted to both the Prosecutor’s Office of the Federation of BiH and the Prosecutor’s Office of Republika Srpska.

The National Assembly instructs the government of the Bosnian and Herzegovina entity to draft and present laws to the Assembly that will ban the functioning of bodies not authorized by the Constitution of BiH within the territory of Republika Srpska, particularly targeting the High Judicial and Prosecutorial Council of BiH, the Court of BiH, the Prosecutor’s Office of BiH, and the Agency for Investigation and Protection of BiH, as noted in their conclusions.

The Assembly strongly condemns the actions of the Prosecutor’s Office of BiH against Parliament members, attributing their actions—performed within their official capacities—to intentions of intimidation and political neutralization, and expresses opposition to any measures executed by the Prosecutor’s Office of BiH or affiliated bodies against parliamentary members.

The resolutions will take effect on the day of their adoption.
