Podgorica resident Nevenka Dragojević has been waiting for justice for more than a decade

Podgorica Resident Nevenka Dragojević Has Been Seeking Justice for Over a Decade

After waiting for eight long years, Nevenka Dragojevic from Podgorica finally received a ruling that requires the investor who deceived her into purchasing an apartment to refund her investment. Despite four additional efforts, Dragojevic faced failure in her pursuit, and according to the verdict, Vladan Nicović still owes her 21 thousand euros solely for the purchase price of the apartment.

Unsurprisingly, Nicović has reportedly resided in Serbia for several years. According to the nation’s entrepreneur registry, he established a company named “Nicović-Consulting” in Belgrade in 2014, which was subsequently removed from the registry in June 2020.

The cadastral records from the Montenegrin Real Estate Administration reveal that Nicović has four real estate listings registered under his name, including real estate list 2976, pertaining to the contested building (KP 2921/5, KO Donja Gorica), where he sold an apartment to Nevenka Dragojević back in 2011.

The now-retired woman, formerly employed at the Blood Transfusion Institute, informed “Vijesti” that despite the rulings issued by both the Basic Court and the Higher Court—which upheld the initial judgment in Podgorica—she has been unable to contact Nicović since 2021 to secure the refund for the apartment she purchased in a building located in Donja Gorica.

“Vijesti” reached out to both the Ministry of Internal Affairs (MUP) of Montenegro and the Ministry of Justice regarding Nicović’s status. However, even after emphasizing the urgency, these departments did not respond to inquiries about whether the state might be searching for him.

Nicović was unreachable via the contact numbers listed in the Serbian Entrepreneurs’ Registry.

Nevenka Dragojević and Vladan Nicović signed a preliminary contract on November 22, 2011, which was executed at a notary’s office by Mira Bogic.

In 2012, several other individuals joined Nevenka Dragojević in filing a complaint against Nicović. The criminal complaint, lodged in October 2012, accused him of “misrepresenting facts to conclude contracts regarding the sale of a two-room apartment,” misleading MP, RV, and DA into signing pre-contracts for the sale of the same apartment through three separate agreements at varying intervals. The complaint indicates that Nicović completed an agreement with MP at the Basic Court in Podgorica, while RV’s pre-contract was notarized by Slavica Bošnjak, and the one with DA was certified by notary Mira Bogić.

“Thus, he led these three individuals to pay a total of 71,000 euros as the purchase price, even while knowing he couldn’t finalize contracts with them for the same apartment,” the complaint stated.

It was also noted that Nicović employed a similar scheme with other apartments:

“He sold the identical apartment to Nevenka Dragojević, GR, and an individual named K,” the report explained, indicating that all these contracts were also witnessed by notary Mira Bogić.

Further allegations claim that Nicović sold the same apartment to ZM, MI, as well as SK and H. Š.

A criminal complaint against Mr. Nicović was subsequently submitted on suspicion of committing fraud, as outlined in Article 244, paragraph 4 of the Criminal Code. The complaint also implicated notaries Bogić and Bošnjak on suspicion of negligent duty performance under Article 417, paragraph 2 of the Criminal Code.

In the specific case of Nevenka Dragojević, the Basic Court in Podgorica ruled in November 2019, partially accepting her claim. The judgment mandated Nicović to refund Nevenka 21,000 euros for the purchase price of the apartment, due to unjust enrichment, as well as compensating her for damages linked to the disputed preliminary contract amounting to 146.25 euros, plus statutory default interest starting from September 14, 2015, until full repayment, to be fulfilled within 2015 days from the ruling becoming final.

The court in Podgorica dismissed part of the lawsuit that sought an additional payment of over 14,000 euros in damages and 525 euros for administrative fees associated with the housing loan Dragojević had taken out at that time…

Moreover, according to the same judgment, Nevenka Dragojević was ordered to pay notary Mira Bogić 2,631.75 euros for civil proceeding costs…

The Basic Court’s ruling was upheld by the Podgorica High Court in 2021.

Notably, when the complaint against Nicović and the notary was filed, the Disciplinary Commission of the Chamber of Notaries had temporarily suspended Mira Bogić from practicing in 2012.

According to earlier reports, the Commission determined that Mira Bogić had acted outside the law in drawing up 11 notarial deeds for ten apartments and one business space in a building owned by Vladan Nicović, despite the building housing only eight apartments.

Also Convicted for Abuse of Official Position

Vladan Nicović’s name has come up not just in the apartment sales scandal in Donja Gorica. Around the same period, he was involved with a property located on Milana Mladenovića Street in the Zabjelo district. Media sources claimed that tenants of that building entered into preliminary contracts with Nicović in 2011, which were certified at the Basic Court. His then-business partner, Semir Mehovic, alleged that Nicović deceived the tenants by signing the preliminary contracts without authorization, operating solely in his own interest.

In mid-2013, the Basic Court sentenced Nicović to four years and four months in prison for abuse of office, tax evasion, and evasion of obligations while serving as the bankruptcy administrator of “Gradski saobraćaj.” At that time, media sources reported that he was tried in absentia as he was on the run, leading to a warrant being issued against him…

Based on cadastre records, Vladan Nicović, besides owning the disputed property in Donja Gorica, has another property in Zabjelo and one in the Tološ area, with one other property in the latter co-owned with another individual.

As per LN 3378, Nicović possesses a family residential building measuring 2794 square meters and a business space of 123 square meters on plot 36. The last recorded change in the cadastral records occurred in 2024, concerning a three-story building with a basement.

In the same settlement, another family residential building of 125 square meters is registered under Vladan Nicović and another individual, with the most recent update in January of this year.

According to LN 6818, Nicović also owns a residential structure of 121 square meters and about 382 square meters of land in the Zabjelo district; changes have been logged as of September 2024.
