Court to Rigorously Uphold Its Jurisdiction
The Union of State Prosecutors urged the court to maintain strict adherence to its jurisdiction, emphasizing the need for an objective and unbiased analysis of evidence to form accurate and lawful decisions.
Judge Veljko Radovanović of the Higher Court in Podgorica explained the first-instance verdict concerning the murder of Ljubiša Mrdak and the robbery of a post office in Nikšić, noting that the court assumed the role of an investigative body considering the claims made in the indictment.
In response, the Union of State Prosecutors’ Offices expressed concern over the judge’s remarks regarding prosecutorial actions, particularly his assertion that “the court had to conduct an investigation due to this indictment.”
They argued that such statements represent an inappropriate intrusion into the prosecution’s jurisdiction and deviate from professional standards that necessitate a clear distinction of roles within the judicial system.
“In a democratic society, the rule of law relies on the principle of independence and mutual respect between judicial authorities. Therefore, any undermining of this balance poses a risk to legal certainty and erodes citizens’ trust in the judiciary,” the response highlighted.
The Union urged the courts to conduct their operations professionally, in line with legal principles and the Code of Ethics.
They stated that public statements concerning the functions of other judicial bodies should foster constructive dialogue rather than publicly contesting decisions, which could create an impression of bias and compromise the judicial system’s integrity.
“We implore that the court remains strictly within its jurisdiction, focusing on an objective and impartial evaluation of the evidence, from which it will draw accurate and lawful conclusions. Meanwhile, the prosecution will maintain its commitment to conduct investigations in a diligent and professional manner in accordance with the law,” the Union emphasized.
They concluded that only through unwavering commitment to professional standards and legal principles can an efficient, independent, and credible judicial system be guaranteed for the benefit of all citizens.
