Trišić changes his statement, claims there was no fight between him and his brother Simonović

Trišić Revises Statement, Denies Altercation with Brother Simonović

Dragoslav Trišić (24) testified that he had no physical altercation with Vladan Mijović in 2019; rather, they merely shoved each other at the entrance to Radosava Simonović’s (44) home, resulting in both of them falling down.

This statement was made during the retrial at the Higher Court, where Radosava Simonović is facing charges for causing serious injuries.

As stated in the indictment, following an altercation in Simonović’s yard on November 4, 2019, the accused is alleged to have stabbed Trišić three times with a kitchen knife.

In a previous ruling that was overturned by the Court of Appeal, Simonović received a sentence of 14 months in prison for attempted murder.

Additionally, Trišić’s aunt and uncle, Radosav Raičević and Jovica Radević, were each sentenced to two months in prison for their involvement in the altercation (they will serve their sentences at home), while the defendant’s brother, Vladimir Mijović, was acquitted of allegations related to the fight, as there was insufficient evidence to prove his involvement.

The defendant’s attorney, Velibor Marković, emphasized that Trišić indicated he only wished to amend his earlier statement, which he notably altered, recalling that during the trial, he admitted to striking Simonović, a point highlighted by the Court of Appeal in its annulment decision.

When asked by the court about his claim to the Prosecutor’s Office that Mijović had struck him, he responded that he made that statement out of anger.

Simonović’s defense previously referenced the pre-incident context involving attacks on the reputation and honor of this single mother’s family and noted that Trišić had assaulted her brother at her doorstep. They cited the expert opinion of neuropsychiatrist Gordana Konatar, arguing that this incident exemplified a case of necessary defense. Simonović maintained her prior assertion that Trišić had attacked the family’s honor and noted that he had confronted her brother at her entrance.

Upon witnessing three individuals attacking her brother on the ground, potentially punching and kicking him, she fetched a knife from the kitchen and struck the first person she encountered.

Expert psychiatrist Gordana Konatar stated that Simonović was experiencing intense anger and fear at the time of the incident. Reiterating her original assessment, she explained that Simonović “was in a state of temporary mental disorder, driven by intense fear for the life of a loved one.”

In response to a question from defense attorney Kasim Dizdarević, Trišić disclosed that he has two or three ongoing criminal cases at the Basic Court in Berane related to forest theft.

The trial will reconvene on March 11, during which the expert witness representative, Prosecutor Željko Golubović, will present his findings.
