Criminal Charges Filed Against Individual and Company for Unauthorized Use of Another’s Design
Police authorities have lodged a criminal complaint with the Podgorica Basic State Prosecutor’s Office against an individual associated with the MV company (49 years old) and the Podgorica-based company SN, based on reasonable suspicions of committing the offense of unauthorized use of an external design.
The announcement indicates that this action has led to both material and non-material damage to the industrial design rights owner, FDL from Podgorica, while providing the accused with unlawful material benefits that remain unspecified.
“During the investigation preceding the complaint submission, it was established that the complainant MV, over the past year, on an Instagram account named SN, at her company’s premises and sales point in Podgorica, significantly breached the industrial design rights that have been officially registered by the Ministry of Economic Development and Tourism on behalf of the rightful holder – a company from Podgorica. This was done by unlawfully placing, marketing, selling, publishing, and making publicly available a protected design belonging to another party,” the statement elaborates.
As a result, it further notes, both material and non-material damage was inflicted upon the holder of the industrial design rights, FDL, and the complainant gained unlawful financial advantage of an undetermined amount.
“Officers from the Crime Prevention Sector are actively continuing their efforts to identify criminal offenses and to bring to justice all individuals and legal entities that, through their business practices aimed at illicit financial gain, inflict economic harm on the state budget of Montenegro and its citizens,” the statement concludes.
